Terms and Conditions - 'Ebony & Ivory Bespoke Hire'

‘The Company’/ ‘We’ refers to The Piano Boat: Ebony & Ivory Bespoke Hire. ‘The Customer’ / ‘You’/ ‘Your’ refers to the customer.

Booking, Deposit and Payment


The Company may provisionally reserve bookings made by phone for up to 7 days, but bookings are only fully confirmed upon receipt of Your required deposit and completed booking form.


Both a non-refundable deposit of 25% of the total booking price and completed booking form are required to secure a booking. Your booking form and our confirmation constitute a legally binding contract between You and The Company. We will be legally bound to provide the services as booked, and You will be legally bound to pay the remaining amount of the total booking price at least 2 weeks before the day of the booking. If a booking is made later than 2 weeks before the date of the booking, payment in full is required immediately.


Bookings may not be transferred to a third party without permission of The Company.

Customer Cancellation and Refunds

 

If You wish to cancel Your booking and receive a refund, this request must be given in writing at least 2 weeks before the date of the booking otherwise You will still be legally bound to provide payment in full.

 

The deposit is non-refundable and only the remaining amount paid is subject to refund.

Operators’ Right of Termination


The Company reserves the right to cancel any booking without prior warning or assigning a reason to do so. We reserve the right to terminate a passenger’s cruise, should the person in our opinion have placed the boat, its equipment or other passengers/crew in danger of damage or injury by ignoring safety advice or instructions of the crew. We reserve the right to terminate the cruise of any passenger found smoking inside the boat or who, in the opinion of the master of the boat, behaves in a manner disruptive to the other passengers.


Any refunds given are entirely at The Company’s discretion.

 


Canal Restrictions and Force Majeure


We reserve the right to cancel any cruise which, due to circumstances beyond our control, has become impossible to carry out/complete. In this case, You will be offered alternative dates if possible, or a refund pro rata for any days not completed. In the case of the cruise not having begun, any sum paid by You will be returned in full if alternative dates are not possible.
We reserve the right to alter a planned cruising route if this becomes necessary due to canal stoppages, water shortages or flooding, or if We deem this to be in the best interests of The Customer. You shall have no claim on us, or particular right of cancellation, should any rerouting be necessary.


Should navigational difficulties prevail on the waterway, the cruise may be rescheduled to commence, divert or terminate at alternative locations in order to safeguard the holiday. This situation will not be considered grounds for cancellation of a confirmed holiday.


Whilst We make every effort to keep to the advertised timetable, We shall not be liable for any loss caused to You by delay, mechanical or electrical breakdown, failure to keep to time, or any other cause.

Personal Accidents and Guests’ Property


We shall not be liable for any loss or damage to any article or personal property belonging to You which may be sustained during the cruise or whilst the articles are upon the boat, or premises or vehicles belonging to us or our agents.


Except in respect of death or personal injury caused by our negligence, We shall not be liable for any personal injury suffered by You during the cruise or whilst upon the boat, or premises or vehicles belonging to us or our agents.


If We advise car parking facilities, We shall not be liable for any loss or damage to Your vehicle or its contents. We are unable to arrange car parking – where We advise facilities, it is Your responsibility to contact the facilities to make direct arrangements to park.


We do not take responsibility for the consequences of not being informed at the stage of booking of any dietary requirements or related health problems or disabilities.

 


General
 

No children under 12 will be carried on board.
 

No pets will be carried on board.

Smoking is not permitted inside the boat which includes e-cigarettes.
 

These conditions shall operate in accordance with English Law and the parties submit to the jurisdiction of the English Courts.
 

Whilst every effort is made to ensure the accuracy of the contents of our website or brochure, we shall not be liable for any inaccuracies that may have occurred.
